1. GENERAL
The following General Terms and Conditions of Business are valid for all contracts, deliveries and other services involving Anima Pompon. Anima Pompon herewith explicitly does not accept different regulations of the contracting party. All collateral agreements require a written confirmation on the part of Anima Pompon.
Anima Pompon is authorised to change or complete these General Terms and Conditions of Business and all its possible enclosures within an appropriate period of notice at any time. Orders arriving before that change will be handled according to the still valid old General Terms and Conditions of Business.
2. RANGE OF PRODUCTS
The range of products of Anima Pompon is not binding. Minor deviations or changes compared to the illustrations or descriptions in the Webshop are possible. Anima Pompon guarantees that every single displayed and shipped item is 100% handcrafted.
3. PRICES
All prices are subject to change. Changes in prices can be made by Anima Pompon at any time without notice. The terms of payment and delivery of Anima Pompon are also listed in the "Payment and Delivery" section. Shipping and handling is 9.90 Swiss Francs for orders within Switzerland and 20.00 Swiss Francs for orders outside of Switzerland. The respective amount will be added directly to the final amount in the basket. The order will be delivered by the Swiss Post via "Priority" shipping".
Changes in prices due to changes of customs duties, import and export charges, price fluctuations, exchange rate fluctuations etc. are reserved.
4. PAYMENT
Orders in the Anima Pompon Webshop can only be paid by PayPal and credit card. This is the safest and most effective way of payment for both the purchaser as well as Anima Pompon. All payments from within Switzerland will be charged in Swiss Francs. All payments from outside of Switzerland will be charged at the then applicable bank exchange rate for the respective foreign currency. Anima Pompon is not involved in determining the exchange rate.

- Customers with PayPal account: The shop automatically initiates the payment and transfers the customer directly to the PayPal website. The order will be processed by Anima Pompon as soon as the payment is completed and confirmed. Before completion and confirmation the order remains pending.
- Customers without PayPal account: Payments can also be made without a PayPal account. The customer just has to click on the "I don't have a PayPal account"-button and will be redirected automatically to the common credit card payment. As soon as the payment is completed and confirmed the order will be processed by Anima Pompon. Before completion and confirmation the order remains pending.
INTERNATIONAL CUSTOMERS:

If the credit card is not valid and the payment cannot be completed and confirmed, Anima Pompon is authorised to refuse the delivery, also for any other or earlier contract with the same customer. Anima Pompon is not liable for any damages or losses caused by this non-delivery.
5. DISPATCH/SHIPPING
Shipping and handling is 9.90 Swiss Francs for orders within Switzerland and 20.00 Swiss Francs for orders outside of Switzerland. The respective amount will be added directly to the final amount in the basket. The order will be delivered by the Swiss Post via "Priority" shipping.

CUSTOM DUTIES AND VAT
Please note that Switzerland is not a member of the EU! On that account, customs duties might be collected! Also the VAT may vary from country to country. The fixing of these taxes and duties is a federal affair and therefore cannot be affected, controlled or changed by Anima Pompon.
6. RESERVATION OF DELIVERY
The order will be parcelled and prepared for shipping within 3 working days from the order date. If Anima Pompon cannot meet this time frame, the customer will be notified immediately.
The customer reserves the right to withdraw from the contract if the delivery is not feasible on part of Anima Pompon. Any claims for damages resulting from delay, impossibility or non-fulfilment (also those evolving by the time of the cancellation of the contract) are excluded.
7. DELIVERY DATES AND PERIODS
The Swiss Post shipping conditions specified in paragraph "5." are not binding and cannot be influenced or affected by Anima Pompon. Specific delivery dates have to be agreed by both sides in written form. The deadline is met if the delivery takes place before the expiration of such date. The delivery period extends adequately in cases of strike/lockout, federal and official orders (import/export restrictions) or in an act of God. Claim for damages in case of noncompliance are excluded.
8. LIABILITY
Anima Pompon disclaims liability for the delivery of the goods. Anima Pompon grants no compensation for losses or damages during transportation.
9. RIGHT OF RETURN
Ordered goods cannot be returned, except for manufacturing errors or if the wrong product was dispatched by Anima Pompon.
10. PASSING OF RISKS
The risk in the goods shall pass to the customer on delivery by Anima Pompon.
11. LIABILITY FOR DEFECTS
Anima Pompon guarantees that all dispatched products are free from material or manufacturing defects when the risk passes from Anima Pompon to the customer.
On arrival of the goods, the customer immediately has to examine the delivery for defects and general quality. Evident as well as latent defects have to be reported to Anima Pompon in written form and within a period of 10 days after they have been discovered. If the defect requires return of the product, the rejected article has to be sent back to Anima Pompon with a copy of the invoice and adequate postage. Our liability does not cover wear and tear. The liability terminates if the customer performs any kind of modification to the product.
12. RESERVATION OF PROPRIETARY RIGHTS
Anima Pompon reserves the proprietary right over the delivered products until all principal and incidental claims have been acquitted. In case of any behaviour contrary to contract Anima Pompon is authorised to reclaim the goods. If the goods are further processes or intermixed with any other kind of good or product, Anima Pompon automatically acquires the co-ownership of that new good or product. In such case, the right of return terminates. The place of jurisdiction is Zurich.
13. DATA STORAGE AND PROTECTION OF PRIVACY
All necessary data for the business transaction between customer and Anima Pompon will be processed and saved. Any personal data will be kept in confidence and will not be passed on to third parties for advertising or any other purposes.

Anima Pompon explicitly dissociates from the content of all webpages linked on the site. The owner of a linked web page is exclusively responsible for its content.
15. PLACE OF JURISDICTION
For both parties, Anima Pompon and the customer, the place of execution and jurisdiction is the domicile of Anima Pompon. Only the Swiss Law is valid and to be applied, place of jurisdiction is Zurich.
